User Agreement

This User Agreement (“Agreement”) is executed between real and/or legal persons using the Chatmatic software (“User”) and Arsol Digital Advertising Information Software Import Export Trade and Industry Limited Company.

Chatmatic is a technological infrastructure that provides messaging and CRM management via WhatsApp, Instagram, Messenger, email, and similar channels. Chatmatic does not control, edit, or take responsibility for content created by the User.

• The User accepts that they are solely responsible for the legal compliance of all data and content uploaded to the System,
• Obtaining the necessary information notices and explicit consents for personal data,
• Ensuring commercial electronic communication permissions in accordance with Law No. 6563.

• The Parties accept within the scope of Law No. 6698 on the Protection of Personal Data (KVKK) that;
• The User is the Data Controller,
• Chatmatic is the Data Processor.

Spam, unauthorized messaging, fraud, unlawful content, and activities that violate the rights of third parties are prohibited.

Chatmatic reserves the right to suspend or terminate the User account in case of violation of this Agreement.

Chatmatic’s liability is limited to the service fees paid within the last 12 months. No liability is accepted for indirect damages.

• 1. SUBJECT: This text regulates the obligations of the parties regarding the processing of personal data by Chatmatic in accordance with KVKK and GDPR.
• 2. PROCESSING UPON INSTRUCTION: Chatmatic processes personal data solely in line with the User’s instructions.
• 3. SECURITY MEASURES: Chatmatic takes the necessary technical and administrative measures to ensure data security.
• 4. SUB-PROCESSORS: Chatmatic may use infrastructure providers as sub-processors.
• 5. DATA BREACH: In the event of a possible data breach, the User shall be informed within a reasonable period.
• 6. LIABILITY: The User may not hold Chatmatic liable for KVKK violations arising from third parties.
